for the sale of products to consumers and businesses
(hereinafter: Customers)
The sale of the Provider's products offered via the online shop at the URL stated above is governed exclusively by the following General Terms and Conditions (GTC) in the version valid at the time the contract is concluded.
These GTC apply exclusively. Any terms and conditions of the Customer that deviate from these GTC shall not apply unless the Provider and the Customer have expressly agreed otherwise.
The offers on the Provider's website constitute a non-binding invitation to the Customer to order products (services). By submitting the order (clicking the "order with obligation to pay" button) on the Provider's website, the Customer submits a binding offer to conclude a contract.
The confirmation of receipt of the order follows immediately after the order is submitted and does not, in principle, yet constitute acceptance of the contract. The Provider may declare acceptance within five days by sending a written order confirmation or an order confirmation in text form (fax or email), whereby receipt of the order confirmation by the Customer is decisive, or by delivering the ordered goods, whereby receipt of the goods by the Customer is decisive, or by requesting payment from the Customer after the order has been placed. If several of the aforementioned alternatives apply, the contract is concluded at the point in time at which one of the aforementioned alternatives occurs first. If the Provider does not declare acceptance within the aforementioned period, this shall be deemed a rejection, with the result that the Customer is no longer bound by their declaration of intent.
When an offer is submitted via the Provider's online order form, the Provider stores the text of the contract and sends it to the Customer, together with these GTC, in text form (e.g. email, fax or letter) after the order has been submitted.
In addition, the text of the contract is archived on the Provider's website and can be retrieved free of charge by the Customer via their password-protected customer account, provided the Customer created a customer account in the Provider's online shop before submitting the order.
Before bindingly submitting the order via the Provider's online order form, the Customer can continuously correct their entries using the usual keyboard and mouse functions. In addition, all entries are displayed once again in a confirmation window before the binding submission of the order and can also be corrected there using the usual keyboard and mouse functions.
The German language is exclusively available for the conclusion of the contract.
The prices listed on the Provider's website at the time of the order apply. All prices include statutory value-added tax plus the shipping costs stated in each case.
The payment methods listed on the Provider's website are available.
For subscription contracts, the purchase price for goods to be delivered on an ongoing basis is due for payment in advance for the respective agreed delivery interval. The respective payment options for the subscription will be communicated to the Customer via the Provider's website. If direct debit is selected as the payment method and a corresponding direct debit mandate is granted, amounts due will be collected from the Customer's bank account at the beginning of each new delivery interval. If the direct debit is not honored due to insufficient funds or incorrect bank details, or if the Customer objects to the debit despite being responsible for it, the Customer shall bear the fees incurred as a result of the reversal by the respective credit institution, provided the Customer is responsible for this.
If the Customer is in default of payment, the Provider is entitled to charge default interest of five percentage points for consumers and nine percentage points for businesses above the base rate of the European Central Bank. Should the Provider assert further damages caused by default, the Customer has the opportunity to prove that the asserted damages caused by default did not occur at all, or occurred to a lesser extent.
Delivery times can be found on the Provider's website. The Provider will indicate any deviating delivery times on the respective product page. The start of the delivery period specified by the Provider requires the timely and proper fulfillment of the Customer's obligations, in particular the correct statement of the delivery address as part of the order.
For subscription contracts, the Customer must notify the Provider of any change of delivery address without delay.
The statutory liability for defects applies. The following deviates from this for contracts for the delivery of goods:
The limitations of liability and shortened time limits set out above do not apply
to the Customer's claims for damages or reimbursement of expenses
where the Provider has fraudulently concealed the defect
to goods that have been used for a building in accordance with their normal use and have caused the building's defectiveness
The Provider is liable to the Customer for all contractual, quasi-contractual and statutory claims, including tortious claims, for damages and reimbursement of expenses as follows:
Otherwise, liability on the part of the Provider is excluded.
The above liability provisions also apply with regard to the Provider's liability for its vicarious agents and legal representatives.
The Customer shall indemnify the Provider against any third-party claims — including the costs of legal defense at the statutory rate — asserted against the Provider due to unlawful or contractually improper conduct by the Customer.

This platform serves as a point of contact for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer. The Provider participates in consumer dispute resolution proceedings under the German Consumer Dispute Resolution Act (VSBG).
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the courts at the Provider's registered office shall have jurisdiction, unless an exclusive place of jurisdiction applies to the dispute. This also applies if the Customer does not have a place of residence within the European Union. The Provider's registered office can be found in the heading of these GTC.
Should any provision of this contract be or become invalid or unenforceable, the remaining provisions of this contract shall remain unaffected.
